Dual Intent Processing Guidelines Update- Spouses & Partners

What is dual intent?

Dual Intent exists when an applicant has applied, or may apply, for permanent residence in Canada and also applies for a temporary resident visa (visitor, student or worker permits).

What are the new guidelines?

While having two intents (permanent & temporary) is legitimate, there has not been a guideline in place specific to the processing of temporary resident visa applications for those who are also being sponsored by a spouses or partners for permanent residency.

The guidelines identify that the following items should be considered, among other factors, when assessing a temporary resident visa application:

  • if the spousal sponsorship application has been approved.

  • if the application for permanent residence has received stage one approval (meaning they have determined the relationship to be legitimate).

  • what ties the applicant has to their home country.

  • what plans are in place, should the permanent resident application be refused.

If an applicant can convince an officer that, if their permanent resident application is refused, they will leave Canada at the end of the period authorized for their stay, the temporary resident visa may be approved.
